Terms of Service

You must be at least 13 years old to use the Service. By using Chatskee, you represent that you meet this requirement and have the legal capacity to agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Chatskee is a group-chat application that may include channels, threaded posts, maps, weather, media uploads, notifications, and related features. The Service is provided free of charge as a personal project of Designs by Chace. We do not guarantee uptime, availability, or any particular service level (no SLA). We may change, suspend, or discontinue any feature at any time, with or without notice.

We provide the platform for you to use. We are a technology provider — not the publisher, author, or endorser of user-generated content.

You may sign in using supported third-party identity providers (such as Google, GitHub, X, or LinkedIn). You are responsible for activity under your account and for keeping access to your provider account secure. Some channels may allow limited guest participation without an account; guest use is still subject to these Terms.

All content posted on Chatskee — including text, images, GIFs, links, reactions, channel names, alerts, and any other materials — is the sole responsibility of the users who create or upload it. Designs by Chace is not liable for content posted to the Service. We only provide the application for use.

You are responsible for ensuring that your content and conduct comply with these Terms, applicable law, and the rights of others (including privacy, publicity, and intellectual property rights). You represent that you have all rights needed to post your content and to grant the license in Section 6.

Channel creators, admins, and members decide what is posted in their channels. What users post in private channels is not something we can reasonably monitor or take responsibility for as if we were the author or editor of that content.

Private channels are membership-gated. Access is controlled by channel admins (for example via invite links). We do not sell private channel content or publicly index it. Members of a private channel can see content other members post in that channel. You understand that “private” means restricted to members of that channel — not that Designs by Chace has zero technical ability to access data as needed to operate, secure, or legally comply regarding the Service.

You retain ownership of your content. By posting or uploading content to the Service, you grant Designs by Chace a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content solely as needed to operate, provide, improve, and protect the Service (including backups, CDN/delivery, moderation tooling, and displaying content to authorized channel members).

You agree not to:

• Violate any law or regulation;
• Post content that is illegal, exploitative of minors, or that you do not have rights to share;
• Harass, threaten, defame, or intentionally harm others;
• Distribute malware, attempt unauthorized access, scrape in an abusive way, or disrupt the Service;
• Impersonate others or misrepresent your affiliation;
• Use the Service to spam, conduct unsolicited commercial messaging at scale, or engage in fraud;
• Interfere with others’ enjoyment of the Service.

Designs by Chace may, in our sole discretion, remove content, restrict features, or suspend or terminate accounts for illegal, abusive, or Terms-violating use — or for any other reason we believe is appropriate to protect the Service or others.

We have no obligation to monitor, review, or police private channels or user content, and we do not undertake a general duty to do so. Failure to remove any particular content does not waive our right to act later.

To report illegal or abusive content or conduct, email privacy@designsbychace.com with enough detail for us to locate the material (channel, approximate time, description, and links or screenshots if available). An in-app report button may be added later; until then, email is the reporting channel.

The Service — including software, design, branding, logos, and documentation (excluding your content and third-party materials) — is owned by Designs by Chace or its licensors. You may not copy, modify, distribute, sell, or reverse engineer the Service except as allowed by law or with our prior written permission.

The Service integrates or relies on third parties (for example identity providers, hosting and databases, maps, weather, image storage, and Giphy). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR AVAILABLE.

Without limiting the foregoing, we disclaim all liability for user-generated content and for interactions between users.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNS BY CHACE AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY USER CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US TO USE THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (CURRENTLY $0BECAUSE THE SERVICE IS FREE) OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Designs by Chace and its owners, operators, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access to the Service (or any part of it) at any time, including if you violate these Terms. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive termination.

We may update these Terms from time to time. The “Effective date” at the top will change when we do. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be posted on this page.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. You agree that courts located in Colorado will have exclusive jurisdiction over disputes arising from these Terms or the Service, except where prohibited by applicable law (including consumer protections that cannot be waived).
